Terms and Conditions

  1. Introduction

1.1. These Terms and Conditions (“Terms”) govern your use of The Smart Job Club website, services, and applications (collectively, the “Service”), which is operated by Sofcomit Limited trading as The Smart Job Club, a company registered in England and Wales.

1.2. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1.3. The Service is a platform that connects Job Seekers with Employers. We are not a party to any employment or other contract formed between Job Seekers and Employers.

  1. Definitions

2.1. “Employer” means a user who posts job vacancies or searches for candidates.
2.2. “Job Seeker” means a user who searches for job vacancies and posts their CV or profile.
2.3. “Content” means any text, graphics, images, audio, video, software, data compilations, and any other form of information capable of being stored in a computer that appears on or forms part of the Service.
2.4. “User” means any party who uses the Service, including both Job Seekers and Employers.
2.5. “User Content” means all Content submitted, posted, or uploaded by a User, including but not limited to job postings, CVs, profiles, and company information.

  1. Account Registration

3.1. To access certain features, you must register for an account. You must be at least 16 years old to register.
3.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
3.3. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

  1. General User Obligations

All Users agree to:
4.1. Use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Service.
4.2. Not transmit any Content that is defamatory, obscene, offensive, hateful, inflammatory, or sexually explicit.
4.3. Not promote violence, discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age, or any other illegal activity.
4.4. Not knowingly introduce viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material.
4.5. Not attempt to gain unauthorized access to the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

  1. Specific Terms for Job Seekers

5.1. Profile and CV: You grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute the Content of your profile and CV to Employers for the purpose of operating the Service.
5.2. Accuracy: You are solely responsible for the Content of your CV and profile and warrant that it is accurate and not misleading.
5.3. Data Protection: You understand and agree that by applying for a job or making your profile searchable, you are consenting to your personal data (including your CV) being shared with the relevant Employer. We are not responsible for how an Employer uses, stores, or processes your data once it has been disclosed to them.
5.4. Right to Withdraw Profile: You can make your profile anonymous or delete it at any time.

  1. Specific Terms for Employers

6.1. Job Postings: You warrant and represent that:
a) All job postings are for genuine vacancies and are accurate and not misleading.
b) You will comply with all applicable laws, including but not limited to the Equality Act 2010, by not discriminating unlawfully in your job postings or recruitment process.
c) You have all necessary permissions and consents to represent the company on whose behalf you are posting the vacancy.
6.2. Use of Candidate Data:
a) You may use candidate data (CVs, profiles, applications) solely for the purpose of evaluating candidates for a specific job vacancy.
b) You must not use candidate data for any other purpose, including but not limited to marketing, selling, or creating a database of candidates for future unspecified roles, without the candidate’s explicit consent.
c) You are responsible for handling candidate data in compliance with all applicable data protection laws, including the UK GDPR and the Data Protection Act 2018.
6.3. Right to Remove: We reserve the right, at our sole discretion, to reject, edit, or remove any job posting that we believe violates these Terms or is otherwise harmful to the Service.

  1. Intellectual Property

7.1. All intellectual property rights in the Service (excluding User Content) are owned by us or our licensors.
7.2. By submitting User Content, you grant us a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and publish that Content for the purposes of providing the Service.

  1. Our Liability

8.1. The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be secure, uninterrupted, or free from bugs or viruses.
8.2. We are not an employment agency or business. We do not vet or verify the accuracy of job postings, CVs, or the suitability of candidates for vacancies. It is the responsibility of Employers to verify the qualifications of candidates and for Job Seekers to verify the suitability of Employers.
8.3. We exclude all implied conditions, warranties, representations, or other terms that may apply to the Service.
8.4. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
a) Use of, or inability to use, the Service; or
b) Use of or reliance on any Content displayed on the Service.
8.5. In particular, we will not be liable for:
a) Loss of profits, sales, business, or revenue;
b) Business interruption;
c) Loss of anticipated savings;
d) Loss of business opportunity, goodwill, or reputation; or
e) Any indirect or consequential loss or damage.
8.6. Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the law of England and Wales.

  1. Termination

9.1. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
9.2. Upon termination, your right to use the Service will cease immediately.

  1. Data Protection and Privacy

Our collection and use of personal information in connection with the Service is described in our separate Privacy Policy, which is incorporated into these Terms by reference.

  1. Changes to these Terms

We reserve the right to modify these Terms at any time. We will post the revised Terms on the Service with an updated “Last Updated” date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

  1. Governing Law and Jurisdiction

12.1. These Terms, their subject matter, and their formation, are governed by the law of England and Wales.
12.2. You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
